Georgia foreclosure sales: first Tuesday, county by county

Where and when every metro county sells, how to find the listings and results, and what happens to the excess funds when a sale brings in more than the debt.

Georgia foreclosure sales happen the first Tuesday of each month at every county courthouse, after four weeks of legal-newspaper advertising. Sales are final when the bidding ends, but the story doesn't end there: when a sale brings in more than the debt owed, the difference (excess funds) legally belongs to the former owner, and it must be claimed.

What happens to the money after a Georgia sale?

The winning bid pays the debt and costs first. Anything left over is excess funds(also called surplus funds or an overage), money that belongs to the former owner. According to publicly available Georgia statute, the county must notify the record owner within 30 days after a tax sale (O.C.G.A. § 48-4-5), but that notice goes to the owner's address on record, usually the property that was just sold. Former owners who moved on rarely ever see it. If your home, or a family member's, was sold at a Georgia foreclosure or tax sale, check what it sold for or request a free record check. Our licensed Georgia attorneys handle claims with no upfront costs.

Georgia foreclosure sale questions

Straight answers, before you ask.

The first Tuesday of every month, between 10 a.m. and 4 p.m., at each county courthouse (or the county's designated online platform where adopted). Every county in Georgia sells on the same day.

Georgia law requires the sale to be advertised once a week for four weeks in the county's official legal organ, a designated newspaper. The ad names the property, the borrower, and the foreclosing law firm.

If the sale brings in more than the debt and costs, the difference (excess funds) belongs to the former owner. For tax sales the county Tax Commissioner holds it (O.C.G.A. § 48-4-5); for mortgage foreclosures the foreclosing attorney holds it (§ 44-14-190). It must be claimed; it is not mailed out automatically. We check the record free, with no upfront costs.

Mortgage foreclosure sales are final when bidding ends. Tax sales carry a 12-month redemption right (O.C.G.A. § 48-4-40) during which the former owner can buy the property back at the price plus a premium.
